Title: Off topic but important: a new sentence of the EUGH regarding facebook

This sentence concerns an older German case. It regards tho the old German legislation, prior to the GDPR. That legislation is very similar to the GDPR, but slightly less strict in some details. So it holds for everything under the GDPR as well. I find it so important that i would like to spread the news here as well.

Please let me now switch to German:

Am 5.6 gab es ein neues EUGH-Urteil zu Fanseiten in Facebook.

Eines ist mir nicht klar: inwieweit betrifft das Leute, die sowieso bei Facebook sind und damit der Verarbeitung ihrer Daten zugestimmt haben? Also insbesondere Seiten oder Gruppen, die nur sichtbar sind, wenn man im Netzwerks angemeldet ist?

Um es klar zu sagen: das betrifft alle, die ihre geschäftliche Repräsentanz in Facebook haben. Und damit alle Band-Pages innerhalb des Netzwerks. Es betrifft auch alle, die sonstige Seiten in Facebook betreiben, und vermutlich auch Gruppen - auch wenn das noch einer juristischen Klärung bedarf.
Dasselbe in Grün natürlich auch bei anderen Netzwerken, z.B. XING.

So, if google translate is helping here, the summary is that facebook page publishers/owners will be considered co-responsible in case of breaches of the GDPR the FB collects statistics and the owner can access some of them. And the facebook pages do not have an "opt-in" for statistics, and as such are in breach of the GDPR.
And this is a judgment by the European Court of Justice.

Sounds right the summary?

I understand the reasoning, and under certain conditions it could be considered correct, but... meh, it looks like quite a long stretch TBH.
I understand the will to go against the commercialization of profiling data, but honestly even for an half-paranoid like me it's becoming a bit too much.

But please note that this is not the end of the story - we need to wait on the final sentence of the highest German court, at least here in Germany. But as i have learned, the German data protection administration is again on the "hard" side for the interpretation. So it might be necessary that we will have to sign contracts with facebooks, maybe even pay for that, and the inform our users in a way that will yet have to be specified.

BTW, slightly unrelated, I wonder why nobody has yet taken the opportunity to spam around emails seeking consent to services you are not subscribed to. xD

why? Well, it has been done. In the first days after May 25th i received several of those mails.

Yes, but strangely enough I received them all from legit sources from which I was subscribed (not that I bothered to read or react to any, but that's another story).
If I were a spammer, I would send out some bunch of emails to people that were not subscribed to my services trying to gain "lawfully" users giving me permission to reuse their data. O:-)

Exactly of this kind were the majority of the mails i actually received.

@bea  Ich hatte einige Tage vorher einen TV-Bericht darüber gesehen.
Diese Wirtschaftsakademie bietet auf ihrer Facebookseite ja auch Produkte und Dienstleistungen gegen Bezahlung an. Auf der Seite gibt es auch Angaben zur Umsatzsteuer.
Und trotzdem gehört so eine Seite in die Kategorie "Fanpage"? Hm.

Unter "Fanpage" verstehe ich eigentlich eine, die von einem Fan über seinen Star erstellt wurde oder eine, die von einem Star für seine Fans erstellt wurde, z.B. von einen Musiker, einem Sportler oder einem Schauspieler. Wo sich die Abonnenten/Liker auch als Fans bezeichnen und nicht eher als "Freunde von", wie es bei dieser Wirtschaftsakademie eigentlich eher heißen sollte.
Ich selber betreibe eine inoffizielle Fanpage über einen Schauspieler bei Facebook. Sie hat jeweils etwa 7800 Abonnenten und Liker. Die Seite ist nicht kommerziell, es wird mit ihr kein Geld verdient und ich selber sammel dort auch keine Daten. Es werden nur Beiträge in Form von Texten, Fotos oder Videos gepostet.
Werden beide Arten von Fanpages trotzdem gleich behandelt/bewertet?

Bezüglich Datenschutz, Daten sammeln und Cookies habe ich bis jetzt bei meinen Infos noch nichts geschrieben. Ich weiß auch gar nicht, was ich da genau schreiben müsste und wie man das am besten formulieren sollte. Zumal das Ganze in Englisch sein müsste und ich das nicht fließend kann. Und gerade bei so etwas Wichtigem würde ich keine Fehler machen wollen.
Gibt's für so was vielleicht schon irgendwo eine Textvorlage? Ich konnte beim Googeln nichts Brauchbares finden.
Mittlerweile müsste ja eigentlich auch jeder, der bei FB ist, mitbekommen haben, dass diese Firma von allen Usern und evtl. auch Besuchern Daten sammelt. Das mit den Cookies ist dagegen möglicher Weise nicht jedem bekannt.

Ich habe gerade noch mal gegoogelt und dabei auf mehreren Internetseiten in der Einleitung gelsesen, dass es in dem Urteil um Facebookseiten geht, die Fanpages von Firmen/Unternehmen sind. Da heißt es z.B. einmal:
Firmen, die eine Facebookseite betreiben - eine sogenannte Fanpage -, sind gemeinsam mit Facebook für die Einhaltung des Datenschutzes auf dieser Seite verantwortlich. Das hat der Europäische Gerichtshof (EuGH) entschieden. Der spezielle Fall könnte Facebook zwingen, Änderungen an allen Fanpages vorzunehmen.

Also fühle ich mich mit meiner privaten "Spaßseite" nun erst mal nicht mehr angesprochen, werde das Ganze aber im Auge behalten.
